Article 1 – Definitions

For the purpose of these Terms:

• "Platform" refers to the Giftworks AI website, applications, and services

• "Customer" refers to any individual or business placing orders or using services

• "Supplier" refers to third-party vendors engaged by Giftworks AI to fulfill orders

• "Products" include all goods and services, including customized and RFQ-based items

• "Order" means a confirmed purchase made through the platform

• "RFQ" means Request for Quotation submitted by a Customer

• "Mockup" refers to a visual representation of customized products

Article 2 – Scope & Applicability

These Terms apply to all users, RFQs, quotations, and transactions.

By using the platform, the Customer confirms acceptance of these Terms.

These Terms override any conflicting terms unless agreed in writing.

Article 3 – Nature of Service

• Giftworks AI operates as a fully managed commerce platform, providing:

• Product discovery

• Customization services

• RFQ handling

• Order processing and fulfillment coordination

All interactions, payments, and support are handled through Giftworks AI.

Article 4 – User Accounts

Users must:

• Provide accurate information

• Maintain account confidentiality

• Be responsible for all account activity

• Giftworks AI may suspend or terminate accounts for misuse.

Article 5 – Product Information

Product descriptions and images are for reference only.

Variations may occur due to manufacturing processes and customization.

Mockups are indicative and may not exactly match final production.

Article 6 – Pricing & Quotations

Prices may vary based on quantity, customization, and RFQ negotiation.

Final pricing is confirmed at order stage.

Giftworks AI may correct pricing errors before confirmation.

Article 7 – Order Placement & Confirmation

Orders are confirmed only after successful payment or RFQ acceptance.

Giftworks AI reserves the right to cancel orders due to stock unavailability or pricing errors.

Article 8 – Payment Terms

Payment must be completed as specified at checkout or as agreed in the RFQ quotation.

Giftworks AI accepts payments via supported gateways only.

Article 9 – Customization & Mockups

Customers are responsible for approving mockups before production begins.

Once approved, changes may not be possible and additional charges may apply.

Article 10 – Delivery

Delivery timelines are estimates and may vary based on production, logistics, and customs.

Giftworks AI is not liable for delays caused by third-party couriers or customs authorities.

Article 11 – Returns & Refunds

Customized products are non-refundable unless they are defective or incorrect.

Claims must be submitted within 14 days of delivery with supporting evidence.

Article 12 – Intellectual Property

All platform content, designs, and materials are owned by Giftworks AI or its licensors.

Customers retain ownership of their uploaded logos and artwork.

Article 13 – Liability

• Giftworks AI's liability is limited to the order value in dispute.

We are not liable for indirect, incidental, or consequential damages.

Article 14 – Governing Law

These Terms are governed by the laws of England and Wales.
